It also outlines your rights under the <span class=\"s2\"><b>Withdrawal Agreement<\/b><\/span> and what to do in complex or compassionate situations.<\/p><h3><b>Who Can Sponsor Their Family to Join Them in the UK?<\/b><\/h3><p class=\"p3\">Under the EU Settlement Scheme (EUSS), only certain individuals can act as sponsors. These are typically people who were already living in the UK by 31 December 2020 and who hold either <span class=\"s2\"><b>Settled<\/b><\/span> or <span class=\"s2\"><b>Pre-Settled Status<\/b><\/span>. The key groups include:<\/p><ul><li>EU\/EEA\/Swiss Nationals with EUSS Status<\/li><li><a href=\"\/lounes\">Dual British\/EU Nationals<\/a><\/li><li>Relevant Person of Northern Ireland<\/li><\/ul><p class=\"p3\">If you hold<a href=\"http:\/\/pre-settled-status\"> <span class=\"s2\">Pre-Settled<\/span><\/a> or <span class=\"s2\"><a href=\"\/settled-status\">Settled Status<\/a><\/span> under the EUSS based on residence before 31 December 2020, you can sponsor close family members, such as your partner, children, or dependent parents, to join you in the UK.<\/p><p class=\"p3\">It is important to note that EUSS Status holders who are j<span class=\"s2\">oining family members<\/span> themselves <span class=\"s2\">cannot act as sponsors<\/span> under the EUSS.<\/p><p class=\"p3\">If you exercised treaty rights in the UK as an EU citizen before the end of transition period, and later <span class=\"s2\">naturalised as a British citizen<\/span>, you are allowed to sponsor family members under the EUSS.\u00a0<\/p><h3><b>Which Family Members Can Be Sponsored?<\/b><\/h3><p class=\"p3\">The EU Settlement Scheme applies only to <span class=\"s2\">qualifying family members<\/span>, meaning the relationship must fall within the definition of a \u201cclose family member\u201d and, in most cases, must have existed <span class=\"s2\">before 31 December 2020<\/span>.<\/p><h5><b>a) Partners (Spouse, Civil Partner, Unmarried Durable Partner)<\/b><\/h5><ul><li><span class=\"s1\">Your relationship must have <\/span>begun before 31 December 2020<\/li><li><b><\/b><span class=\"s1\">You must be <\/span>married or in a durable partnership<span class=\"s1\"> when applying <\/span><\/li><\/ul><p class=\"p3\"><span style=\"font-size: 16px;\">It is important to note that marriages or relationships started after 31 December 2020 <strong>do <\/strong><\/span><strong><span class=\"s2\" style=\"font-size: 16px;\">not qualify<\/span><\/strong><span style=\"font-size: 16px;\"> under EUSS. These cases may need to consider other UK immigration routes, such as a <a href=\"\/uk-spouse-visa\">Spouse Visa<\/a>.<\/span><\/p><h5><b>b) Children (including Adopted Children) and Grandchildren<\/b><\/h5><p class=\"p3\">Children under 21 can usually join their parents with minimal documentation, typically just a <span class=\"s2\">birth certificate<\/span> naming the sponsor.<\/p><p class=\"p3\">For children over 21, <span class=\"s2\">evidence of dependency<\/span> must be provided.\u00a0<\/p><h5><b>c) Parents and Grandparents<\/b><\/h5><p class=\"p3\">You may bring parents or grandparents to the UK <span class=\"s2\">only if you can prove they are dependent<\/span> on you financially or emotionally. Dependency means the family member cannot meet their essential living needs without your support.<\/p><h3><b>Retained Rights of Residence<\/b><\/h3><p data-pm-slice=\"1 3 []\">In certain circumstances, individuals can apply under the EU Settlement Scheme even if the relationship with their EU citizen sponsor has ended. This applies to those who have not yet obtained settled status.<\/p><p>Retained rights of residence apply in the following scenarios:<\/p><ul><li>The EU citizen sponsor has passed away;<\/li><li>The couple have divorced or ended their civil partnership;<\/li><li>The relationship ended due to domestic abuse;<\/li><li>The sponsor has left the UK.<\/li><\/ul><h5><b>a) If Your Family Member Has Passed Away<\/b><\/h5><p class=\"p3\">You may qualify if:<\/p><ul><li class=\"p1\">Your sponsor passed away after 31 December 2020<\/li><li><p class=\"p1\"><span class=\"s1\">You had lived with them in the UK for <\/span>at least one year immediately before their death<\/p><\/li><\/ul><h5><b>b) Relationship has Broken Down<\/b><\/h5><p class=\"p3\">If the marriage or civil partnership with an EU\/EEA\/Swiss national has legally ended, applicant may still apply if:<\/p><ul><li class=\"p1\">The marriage lasted <span class=\"s1\"><b>at least 3 years<\/b><\/span> and the couple lived in the UK for at least one year, or<\/li><li class=\"p1\">The applicant has custody of their ex-partner\/spouse&#8217;s child, or<\/li><li class=\"p1\">The applicant has court-ordered access to their ex-partner\/spouse&#8217;s\u00a0 child, or<\/li><li class=\"p1\">There are \u201cparticularly difficult circumstances\u201d, such as domestic abuse<\/li><\/ul><h5><strong>c) Relationship has Broken Down due to Domestic Violence<\/strong><\/h5><p>Durable partners cannot retain rights on the basis of the duration of the relationship or shared custody alone. They may only retain a right of residence following domestic abuse.<\/p><h5>d) The Sponsor has left the UK<\/h5><p>Children of deceased EU citizens, or of EU citizens who have left the UK, can also retain rights if they remain in education, as can their custodial parent or legal guardian.<\/p><h3><b>How to Apply as a Joining Family Member?<\/b><\/h3><h5><b>Applying from Outside the UK<\/b><\/h5><p class=\"p1\">Joining family members must first apply for an <span class=\"s1\">EUSS Family Permit<\/span> before travelling to the UK. Once they are in the UK, they must apply for Pre-Settled Status within <span class=\"s1\">three months of their arrival.<\/span><\/p><h5><b>Applying from Inside the UK<\/b><\/h5><p class=\"p1\">If the joining family members are already in the UK (e.g. as a visitor), they may apply for Pre-Settled Status under EU Settlement Scheme. This application is normally submitted <strong>within three months<\/strong> of their first arrival to the UK as a joining family member.<\/p><p class=\"p1\">Applications made after the three-month deadline will be treated as <span class=\"s1\">late applications<\/span>, and may be deemed <span class=\"s1\">invalid<\/span> unless the applicant provides <span class=\"s1\">reasonable grounds<\/span> for the delay. Invalid applications do <span class=\"s1\">not attract a right of appeal<\/span>.<\/p><p class=\"p3\">Once Pre-Settled Status is granted, it is important to <span class=\"s2\">build a residence history in the UK. <\/span>This can include actions such as registering with a GP, opening a bank account, adding your name to utility bills, or keeping HMRC records. These will help support your future application for <span class=\"s1\">Settled Status<\/span> after completing the required <span class=\"s1\">five years of continuous
