If your appeal is heard, the case will be considered by an independent Immigration Judge, who will decide whether the Home Office\u2019s decision was lawful.<\/p><p class=\"p1\">At the First-tier Tribunal hearing, there are usually three parties:<\/p><ul><li class=\"p1\"><span class=\"s1\">The Appellant<\/span> &#8211; the person bringing the appeal (represented by their legal representative)<\/li><li class=\"p1\"><span class=\"s1\">The Respondent<\/span> &#8211; the Home Office (represented by the Home Office presenting officer)<\/li><li class=\"p1\"><span class=\"s1\">The Immigration Judge<\/span> &#8211; the independent decision-maker<\/li><\/ul><h3><b>When Can You Appeal?<\/b><\/h3><p class=\"p1\">You may have a right of appeal to the First-tier Tribunal if the Home Office has:<\/p><ul><li class=\"p1\">Refused your human rights or protection claim<\/li><li class=\"p1\">Refused your EU Settlement Scheme application<\/li><li class=\"p1\">Made a decision to deport or remove you<\/li><li class=\"p1\">Refused a family or private life application<\/li><\/ul><p class=\"p1\">You can only appeal if your refusal letter says that you have a right of appeal. Not all immigration refusals attract a full right of appeal.<\/p><h3><b>What Happens at a First-tier Tribunal Hearing?<\/b><\/h3><p class=\"p1\">Once your appeal is lodged, the Tribunal will list your case for a hearing. You will receive a <span class=\"s2\">Notice of Hearing<\/span> in advance.<\/p><p class=\"p1\">On the day of the hearing:<\/p><ul><li class=\"p1\">You (the appellant) will attend in person or remotely<\/li><li class=\"p1\">A Home Office Presenting Officer may attend to defend the refusal<\/li><li class=\"p1\">Your barrister or advocate will make legal submissions and may ask you questions to give evidence<\/li><li class=\"p1\">The judge may ask questions to clarify the facts<\/li><li class=\"p1\">Your legal representative will respond to any points raised by the Home Office<\/li><\/ul><p class=\"p1\">Hearings are usually completed in one day. The judge may give an oral decision at the end of the hearing or issue a written decision within a few weeks.<\/p><p class=\"p1\">If your appeal is <span class=\"s2\">allowed<\/span>, the Home Office can appeal that decision within 14 days.
