Indefinite Leave to Remain (ILR), also known as settlement, allows you to live, work and study in the UK without immigration time restrictions. Once granted, you will no longer need to extend your visa, and you may be eligible to apply for British citizenship in the future.

The qualifying period depends on your immigration route:

  • 5 years: Many Skilled Workers, spouses, partners and other eligible visa holders.

  • 10 years: Applicants qualifying through long residence or certain family and private life routes.

  • 3 years: Certain applicants under the Global Talent or Innovator Founder routes.

Some applicants may qualify sooner under special provisions. Eligibility is subject to the Immigration Rules in force when applying.

For many settlement routes, applicants must not have been absent from the UK for more than 180 days in any 12-month period.

Different rules and transitional arrangements may apply, particularly for long residence and absences occurring before 11 April 2024. Certain exceptional circumstances may also be disregarded.

We recommend reviewing your travel history before submitting an application.

Yes. For many settlement routes, you may apply up to 28 days before completing the relevant qualifying residence period.

You should ensure that your immigration permission remains valid when submitting your application.

Standard ILR applications are generally decided within six months, although processing times vary.

Priority or super priority services may be available for an additional fee, depending on the application route and available appointments. Complex cases may take longer.

Eligibility depends on your immigration status, length of lawful residence and personal circumstances. Common settlement routes include Skilled Worker visas, family visas, and long residence. Applicants must satisfy the requirements of their particular immigration route.

Yes. Under the long residence route, you may qualify after completing 10 years of continuous lawful residence in the UK.

Different immigration permissions may count towards the qualifying period, including certain Student and work visas. However, some categories, such as visitor permission, are excluded. Absences, gaps in lawful residence and immigration history must also be assessed.

Most applicants aged between 18 and 64 must pass the Life in the UK Test unless an exemption applies.

English language requirements depend on the settlement route and the evidence already accepted by the Home Office. Some applicants may rely on qualifications or previous immigration applications rather than taking another test.

As of October 2026, the standard Home Office application fee is £3,226 per applicant.

Additional costs may include the Life in the UK Test, English language test, and optional priority processing.

Home Office fees are subject to change.

Yes. ILR can lapse following an extended absence from the UK, generally after more than two consecutive years outside the UK for ordinary ILR holders.

ILR may also be revoked in certain circumstances, including deception or serious criminality.

Different absence rules apply to settled status under the EU Settlement Scheme.
