UK Sponsor Licence 2026 Business Guidance

Obtaining a sponsor licence is the formal authorisation that allows a UK business to employ non-settled workers under the Worker and Temporary Worker routes. The regime is technical and spread across hundreds of pages of Home Office guidance. Below is a clear, business-focused overview of how the system works, what evidence is required, and what to expect both before and after a licence is granted.

Who needs a Sponsor Licence?

If your UK company intends to employ non-settled workers under routes such as the Skilled Worker or Global Business Mobility routes, you must hold a Sponsor Licence.

The application is made online and must be supported by specified documentation. Once approved, the business will use the Sponsorship Management System (SMS) to assign Certificates of Sponsorship (CoS) to eligible roles.

A Sponsor Licence is granted without a fixed expiry date. However, licences are subject to ongoing compliance monitoring and may be suspended or revoked if sponsor duties are not met. A licensed business will be added to the public Register of Sponsors and may then sponsor workers who meet the relevant immigration requirements.

Is Your Business eligible to apply For a UK Sponsor Licence?  

Before granting a licence, UK Visas and Immigration (UKVI) must be satisfied that your organisation is a genuine UK business operating lawfully; is capable of complying with sponsor duties; and can offer genuine employment that meets the relevant skill and salary requirements.

UKVI may assess your HR and record-keeping systems; any relevant criminal convictions or civil penalties of the key personnel and the business; whether you are already employing anyone in breach of their conditions; and whether the roles your business intend to sponsor are genuine and appropriate.

UKVI may conduct pre-licence compliance visits (either in person or remotely), and in some cases may inspect home addresses where sponsored workers are based remotely.

In practice, the Home Office now applies increased scrutiny to the “genuine vacancy” requirement, particularly for smaller or first-time sponsors. Caseworkers will assess whether the role is credible in the context of the business’s size, structure, and level of trading activity.

What are Key Personnel of a Business?

As part of the application, you must nominate individuals to manage the licence:

  • Authorising Officer (AO) – A senior person from the organisation responsible for overall compliance
  • Key Contact – UKVI’s primary point of contact
  • Level 1 User – Responsible for day-to-day management of the licence via the Sponsorship Management System (SMS)

UKVI requires at least one Level 1 User who is a settled worker/British citizen throughout the life of the licence (subject to limited exceptions). Decision notices are issued to the Authorising Officer, while document requests are usually sent to the Key Contact. Communications will only be directed to a legal representative if they are formally appointed as the Key Contact.

Prepare for Your Business’ UK Sponsor Licence Application

The application is made online and must be accompanied by the relevant Home Office fee, which depends on the size and status of the business. A priority service may be available in limited cases.

You must normally submit the required supporting documents within 5 working days of the application. UKVI may request additional information, typically within a short timeframe.

The Authorising Officer must sign the submission sheet, and supporting documents must be provided in the specified format.

Where risk indicators are identified, UKVI may conduct a compliance inspection and interview relevant personnel before making a decision. If approved, you will receive an A-rated Sponsor Licence; your sponsor licence number; and an initial allocation of Certificates of Sponsorship (CoS). If refused, there is no right of appeal. However, an error correction request may be submitted within 14 calendar days where a caseworking error is identified. A cooling-off period may apply before a fresh application can be made.

The Home Office has increased enforcement activity in recent years, including both pre-licence assessments and post-licence audits. Sponsors must therefore ensure that systems are fully compliant from the outset.

Ongoing Sponsor Duties after Approval

Following grant, sponsors must comply with ongoing duties, including:

  • maintaining accurate records
  • conducting compliant right to work checks
  • reporting changes via the Sponsorship Management System (SMS)
  • monitoring sponsored workers’ immigration status and employment conditions.

Failure to meet these duties can result in licence downgrading, suspension, or revocation.

What Evidence UKVI typically expects (Appendix A)?

Appendix A of the Sponsor Guidance sets out the documents typically required. For many SMEs, core documents include:

  • Employer’s liability insurance (min. £5m)
  • Recent business bank statements from a UK-regulated bank
  • PAYE and National Insurance registration evidence
  • Proof of business premises (such as a lease or ownership documents)
  • A hierarchy chart naming directors/owners and staff structure

Failure to provide mandatory documents can result in refusal. UKVI may allow a short period to provide additional information where requested.

Skilled Worker Roles: Genuineness, Skill and Salary

For Skilled Worker sponsorship, UKVI assesses whether the role is a genuine vacancy aligned to an eligible occupation code, at the appropriate skill level, and paid at or above the route salary threshold and the occupation’s going rate. In practice, clear job descriptions, credible organisational context, and consistent supporting evidence are essential to demonstrate compliance.
